GAMSTOP TERMS OF USE
Please read these terms of use (the Terms) carefully before using our website (our site) or the GAMSTOP service (GAMSTOP), as they contain important information regarding your use of our site, GAMSTOP, and our relationship with you. We last updated these Terms of Use on 19th December 2024.
Who We Are
We are The National Online Self Exclusion Scheme Limited (we, us, or our) - you may also see or hear of us being referred to as NOSES or GAMSTOP.
We are a limited liability company registered in England and Wales. Our company number is 10504973 and our registered office address is 3 Greengate, Cardale Park, Harrogate, HG3 1GY. We are part of the GamStop group of companies.
What is GAMSTOP?
GAMSTOP is a free self-exclusion service set up to help you avoid online gambling if you wish to do so. All businesses that are licensed to offer online and other remote (for example, via telephone, email, SMS, text and instant messaging services) gambling services to individuals in Great Britain (Gambling Operators) must implement procedures for self-exclusion and take all reasonable steps to refuse to offer their service to, or to prevent, an individual who has entered a self-exclusion agreement from gambling.
Since 31 March 2020 all Gambling Operators must be part of GAMSTOP as a condition of the licence granted to them by the Gambling Commission.
If you register for GAMSTOP, we will help prevent you from accessing all gambling websites, apps and services provided by Gambling Operators, including new operators which may open in the future. You can access the details of all Gambling Operators on the Gambling Commission's Public Register.
It is important for you to understand that GAMSTOP can only assist to exclude you from engaging in gambling services offered by the participating Gambling Operators. We are unable to help prevent you from accessing gambling services that are operated by organisations which do not participate in GAMSTOP. A full list of Gambling Operators participating in GAMSTOP is available here.
These Terms of Use
These Terms govern your use of our site and GAMSTOP, which is accessible via our site.
Please read these Terms carefully before you access our site or use GAMSTOP. We recommend that you bookmark this page for future reference.
By accessing our site and by using GAMSTOP, you confirm that you accept and understand these Terms, which form a binding agreement between you and us.
If you do not agree to these Terms, you must not use our site or register for GAMSTOP. If you register for GAMSTOP and later decide that you do not agree to these Terms, you will still remain bound by them.
Changes to these Terms
We may make reasonable changes to these Terms from time to time, where necessary for compliance with a legal obligation or the effective operation of GAMSTOP or your self-exclusion.
We will try to notify you if we make any significant changes to these Terms. But every time you visit our site or use GAMSTOP, please check these Terms to take note of any changes we have made and to ensure you understand the Terms that apply at that time.
GAMSTOP terms
Registering for your self-exclusion
Although you can access certain parts of our site without having to register, to be able to use GAMSTOP to self-exclude, you will need to register for your self-exclusion.
Registration Information
You understand and agree that to register for your self-exclusion, you must provide us with the following information (Registration Information):
- your full name and title,
- your date of birth,
- any mobile numbers you use or have used to register with Gambling Operators,
- your primary email address, together with any other email addresses you use or have used to register with Gambling Operators, and
- your home address (including post code), together with any other addresses which you use or have used to register with Gambling Operators.
Exclusion Period
You understand and agree that during the registration process you must select a minimum duration for your self-exclusion (your Minimum Exclusion Period).
The options we offer at registration are:
- six months,
- one year,
- five years, or
- five years with auto renewal.
Auto renewal
If you select the auto renewal option either at registration or during a five-year Minimum Exclusion Period, immediately after the expiry of your current five-year Minimum Exclusion Period, a new five-year Minimum Exclusion Period will automatically begin.
This process will continue for four new five-year Minimal Exclusion Periods or until you turn off auto renewal from your GAMSTOP account. You understand and agree that you may only turn off the auto renewal option during the last six months of a five-year Minimum Exclusion Period.
Consequently, if you automatically begin a new five-year Minimum Self Exclusion Period, you shall remain self-excluded for at least a further five years. At that point it will be four years and six months until you again have the option to turn off auto renewal to prevent another further five-year Minimum Exclusion Period from beginning.
After four years and six months has passed, you will be able to turn off auto renewal from your GAMSTOP account to prevent another further five-year Minimum Exclusion Period from beginning.
If you do turn off auto renewal and your Minimum Exclusion Period expires, you will still remain self-excluded until you follow the deactivation process set out below.
You can opt-in for emails at registration or during your self-exclusion via your GAMSTOP account that remind you to update your Registration Information.
Email address verification
You understand and agree that you must also verify your primary email address. We will send an email to this address with a link for you to verify that it belongs to you. You understand and agree that we will collect the IP address of any device that opens this email.
Once you have verified your primary email address, you can continue the registration process. You will be given the chance to review the information you have provided before you start the identity verification process.
Identity verification
Once you have provided us with the above Registration Information and verified your email address, we will need to verify your identity. We currently use two third-party verification providers: TransUnion, and Onfido. We may choose to use different third-party verification providers in the future.
If you select the TransUnion process, you understand and agree that you must answer a series of questions about your identity.
If you select the Onfido process, you understand and agree we will need a photo of you and an official photographic ID document which Onfido will compare using facial recognition technology. You understand that we will separately ask for your explicit consent to use facial recognition technology during the Onfido process.
In some cases, it may not be possible for TransUnion or Onfido to verify you. We will let you know if that happens. In these cases, you agree to provide official ID documents to the GAMSTOP Contact Centre before you can complete the registration process.
Confirmation email
When you have successfully registered for your self-exclusion or a further Minimum Exclusion Period, we will send an email confirming your registration.
You understand and agree that we will collect the IP address of any device that opens a confirmation email.
Further information
Further information on how we use your personal data for verification purposes is set out in our Privacy Policy. You can also find out more about how to register for GAMSTOP on our site here.
Consequences of registration
YOU UNDERSTAND AND AGREE THAT ONCE YOU HAVE COMPLETED YOUR REGISTRATION, YOU WILL NOT BE ABLE TO DEACTIVATE YOUR SELF-EXCLUSION UNTIL THE END OF YOUR MINIMUM EXCLUSION PERIOD.
You understand and agree once you have completed your registration, we will activate your self-exclusion.
You understand and agree that although we take care to activate self-exclusions as soon as possible, and generally do so within 24 hours, we cannot guarantee that your self- exclusion will take effect within this timeframe.
You understand that whether and how quickly your self-exclusion takes effect on Gambling Operators' websites and apps will depend on the effective operation of Gambling Operators' systems. You understand and agree that we are not responsible for implementation of your self-exclusion on Gambling Operators' systems.
Your self-exclusion
You understand and agree that, during your self-exclusion, we will use reasonable efforts through GAMSTOP to prevent you from accessing any accounts you hold or attempt to open with Gambling Operators, that match your Registration Information.
You understand and agree that GAMSTOP may not be able to spot inaccuracies or other differences in your Registration Information. You understand and agree that our ability to assist in preventing you from accessing Gambling Operators' services may be hampered if you do not provide us, at the point of registration and during your self-exclusion, accurate and up-to-date Registration Information.
You understand and agree that GAMSTOP will not be responsible for identifying any errors in your Registration Information or any other errors on your part on your part when accessing GAMSTOP.
You understand that if you have withdrawable funds remaining in your gambling accounts once your self-exclusion has been activated, it is the responsibility of the Gambling Operator and not GAMSTOP to return these funds to you. You understand that the details of how this will be done will depend on the Gambling Operator in question, and that the return of such funds is not our responsibility.
We shall administer your self-exclusion as described in these Terms. You agree that GAMSTOP may use any personal data relating to you, whether collected at registration or otherwise and whether collected directly from you or otherwise (including from Gambling Operators or third-party verification providers), to the extent necessary for the performance of our obligations under these Terms, and in accordance with our Privacy Policy.
GAMSTOP is a tool to help you avoid online and other forms of remote gambling. We cannot and do not guarantee that GAMSTOP will always result in you being denied access to a Gambling Operator or gambling activity.
Your responsibilities
You understand and agree that your self-exclusion is:
- intended to be an aid to help you manage your use of online and other remote gambling services,
- not intended to function as a replacement for willpower,
- not foolproof or guaranteed to always result in you being denied access to gambling services, and
- most effective if you do not try to work around GAMSTOP's exclusion measures.
During the period of your self-exclusion, you specifically agree not to:
- attempt to register new gambling accounts with Gambling Operators,
- log in to any of your existing accounts with Gambling Operators, or
- in any other way try to circumvent GAMSTOP's mechanisms for the duration of your self-exclusion.
You understand and agree that you are entirely responsible for any actions you take that are designed to circumvent the operation of GAMSTOP or your self-exclusion.
You understand and agree that the operation of GAMSTOP and your self-exclusion may not be as effective in circumstances where you provide, or we otherwise receive inaccurate, incomplete or out-of-date information. You understand you can opt-in for emails at registration and via your GAMSTOP account that remind you to update your Registration Information.
You agree that you will provide Registration Information that is:
- truthful and accurate, and
- consistent with and in the same format as the information you have used to access online gambling services with Gambling Operators.
It is your responsibility to keep your GAMSTOP account information up-to-date. Failure to do so may result in your self-exclusion being less effective. If you would like to change or update any of your registration details (for example, if you change your address), please do so via your GAMSTOP account or call the GAMSTOP Contact Centre to speak to us regarding any such changes. If you have changed your name, you will need to call the GAMSTOP Contact Centre.
You understand and agree that you are responsible for maintaining the confidentiality of any information forming part of your self-exclusion registration.
You understand and agree that:
- your GAMSTOP account is your responsibility,
- you are responsible for maintaining appropriate confidentiality of any correspondence you receive from us,
- you are responsible for maintaining appropriate confidentiality of your GAMSTOP account and login details (including password),
- you are solely responsible for all activities that occur under your GAMSTOP account and for any access to or use of GAMSTOP by you or any person or entity using your GAMSTOP account, whether or not such access or use has been authorised by you (except where such access or use was due to our inappropriate action or inaction),
- we will not be liable for any loss or damage whatsoever resulting from the disclosure of your GAMSTOP account details by you contrary to these Terms, and
- we have the right to disable any GAMSTOP account login details (whether chosen by you or allocated by us) at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms.
You agree to immediately notify us of any unauthorised use of your account or any other breach of security.
Registering on behalf of someone else
You understand and agree that you must not attempt to register for self-exclusion on anyone else's behalf.
Registering on behalf of someone else, unless you are lawfully entitled and authorised to do so (for example, under a valid power of attorney) is a breach of these Terms and could expose you to legal liability to us and the person on whose behalf you registered.
Personal data
You agree to provide us with your Registration Information during the registration process.
You agree to ensure your Registration Information is accurate, up-to-date, comprehensive and relevant during the period of your self-exclusion. You understand and agree that if you fail to keep your Registration Data up to date, we reserve the right to do either or both of restricting your account and ending your participation in GAMSTOP.
You agree to provide us with any other personal data we reasonably need for the efficient operation of your self-exclusion.
You understand and agree that we may receive and process your personal data when you contact the GAMSTOP Contact Centre or via your GAMSTOP account.
You understand and agree that we will receive your personal data from and share your personal data with Gambling Operators for the purposes of:
- completing regular checks to identify self-excluded individuals within their ustomer databases,
- checking whether individuals attempting to access their online gambling services are self-excluded,
- the performance of these Terms,
- our legal obligations,
- the legal obligations of Gambling Operators, and
- as otherwise needed for the effective operation of GAMSTOP or your self-exclusion.
You understand and agree that we may also receive personal data from other third-party sources (for example, third-party verification providers).
Our Privacy Policy describes in more detail how we process and how long we hold your personal data for the purposes of GAMSTOP and your self-exclusion. We will only use your personal data as described in our Privacy Policy or otherwise notified to you.
You confirm that you have read and understood our Privacy Policy. You specifically agree to us using your personal data for the purposes of GAMSTOP and your self-exclusion as described in the Terms and our Privacy Policy (as it may be updated from time to time).
Our Cookie Policy (as it may be updated from time to time) sets out information about the use of cookies on our site.
We may make reasonable updates to our Privacy Policy and Cookie Policy from time to time where necessary for compliance with a legal obligation or the effective operation of GAMSTOP or your self-exclusion.
The content of our Privacy Policy and (to the extent relevant) our Cookie Policy is incorporated into and forms part of these Terms.
The end of your self-exclusion
You understand and agree that we will not:
- automatically remove your self-exclusion at the end of a Minimum Exclusion Period, or
- contact you to let you know that a Minimum Exclusion Period has expired.
If you have not selected the auto-renewal option, on expiry of your Minimum Exclusion Period, you may, via your GAMSTOP account or the GAMSTOP Contact Centre, extend your self-exclusion for a further Minimum Exclusion Period of six months, one year or five years. Alternatively, you may also choose to deactivate your self-exclusion.
You understand and agree that if you do choose to deactivate your self-exclusion:
- you must contact the GAMSTOP Contact Centre by phone to notify us of your decision to deactivate your self-exclusion, and
- we will not deactivate your self-exclusion within a minimum 24-hour "cooling- off" period (beginning at the end of your phone call to request deactivation), during which your self-exclusion will remain active.
You understand and agree that during the minimum 24-hour cooling-off period, your self-exclusion will remain active.
You understand and agree that:
- until you contact the GAMSTOP Contact Centre by phone following the expiry of your Minimum Exclusion Period, your self-exclusion will continue for up to a further seven years from the expiry date of your initial Minimum Exclusion Period, and
- once this subsequent seven-year period expires, your self-exclusion will be deactivated.
You understand and agree that if you select the auto renewal option either at registration or during a five-year Minimum Exclusion Period:
- immediately after the expiry of your current five-year Minimum Exclusion Period, a new five-year Minimum Exclusion Period will automatically begin,
- you will not be able to deactivate your self-exclusion until the expiry of that new Minimum Exclusion Period,
- this process will continue for four new five-year Minimum Exclusion Periods or until you turn off auto renewal from your GAMSTOP account,
- you may only turn off the auto renewal option during the last six months of any ongoing five-year Minimum Exclusion Period, and
- If you do turn off auto renewal and your current Minimum Exclusion Period expires, you will still remain self-excluded until you follow the deactivation process set out above.
Post self-exclusion period
You understand and agree that if you contact the GAMSTOP Contact Centre after the end of your Minimum Exclusion Period to remove your self-exclusion, for a further seven-year post-self-exclusion period we will inform Gambling Operators that you were previously self-excluded with GAMSTOP.
You understand that Gambling Operators do not have to prevent you from accessing gambling platforms during this time, but they may choose to prevent you from accessing gambling platforms outside of GAMSTOP. You understand that we have no influence over whether a Gambling Operator prevents you from accessing online gambling platforms outside of GAMSTOP.
Retention
If you do not deactivate your self-exclusion after the expiry of your Minimum Exclusion Periods, we will hold your data for:
- all your Minimum Exclusion Periods (which were either added manually by you or automatically renewed),
- the further seven-year automatic self-exclusion period described above, and
- then a further archive period of seven years.
If you do deactivate your self-exclusion after the expiry of your Minimum Exclusion Period, we will keep your data for:
- all your Minimum Exclusion Periods (which were either added manually by you or automatically renewed),
- an additional period of self-exclusion beginning on the expiry of your last Minimum Exclusion Period and lasting until you remove your self-exclusion,
- a seven-year post-self-exclusion period beginning when you remove your last self- exclusion (during which period we will inform Gambling Operators that you were previously excluded, as described above), and
- then a further archive period of seven years.
More detailed information on how we long we keep your personal data for is set out in our Privacy Policy.
